Introduction: This article analyses the evolution of the legal protection of women workers in Mozambique through a comparative analysis of Labour Law No. 23/2007 of 1 August and Law No. 13/2023 of 25 August.
Objective: The study examines the extent to which the 2023 legislation represents a normative advance over the previous regime.
Methodology: In order to avoid a merely descriptive comparison, prior assessment criteria are established concerning maternity protection, paternity and family co-responsibility, protection against harassment and discrimination, equal remuneration, reconciliation between work and family responsibilities, and working-time arrangements. Methodologically, the research adopts a qualitative, legal-doctrinal and comparative approach, based on the analysis of legislation, international instruments and relevant literature.
Results: The comparison reveals relevant advances in the duration of maternity leave, paternity leave, protection against harassment, and the explicit strengthening of equality and non-discrimination. However, it also shows that some measures previously attributed to the new law, such as the creation of childcare facilities or a general right to flexible working hours specifically for mothers, are not directly supported by the statutory text.
Conclusion: The article concludes that Law No. 13/2023 represents a relevant normative advance, although this progress is partial and does not eliminate implementation and enforcement challenges.
KEYWORDS: gender equality; harassment; maternity protection; Mozambique; women workers.
