Introduction: This article analyzes the issue of the five-year statute of limitations for labor claims during the term of an employment contract, especially in cases of arbitrary dismissal, highlighting the structural asymmetry between employee and employer and the incidence of fundamental duties in private relationships.
Objetive: The study aims to demonstrate that the violation of the employer's fundamental duty to justify dismissal renders the application of the five-year statute of limitations during the employment relationship incompatible, requiring a systematic interpretation of Articles 7, I and XXIX of the Constitution.
Methodology: The historical-dialectical materialist method is used, which articulates constitutional text, socioeconomic reality, and power relations, combined with the examination of a specific case for the purposes of critical reasoning.
Results: The findings indicate that the absence of valid grounds for dismissal prevents the five-year statute of limitations from running, under penalty of transforming this institution into a mechanism for forced renunciation of fundamental rights. The analysis of Case No. 0013143-52.2016.5.15.0002 shows that the TRT-15 applied the theory of fundamental duties in a manner consistent with the Constitution, while the TST upheld the result on procedural grounds.
Conclusion: It is concluded that the fundamental duty to justify dismissal prevents the five-year statute of limitations from running during the contract and reveals the need for labor dogma that recognizes and systematizes the constitutional duties of employers in private relations, ensuring effective protection of workers' dignity.
KEYWORDS: employer's fundamental duty to provide reasons for dismissal; fundamental duties in employment relationships; inapplicability of the five-year statute of limitations in labor law; protection against arbitrary dismissal.
